Maryland, DC to sue Trump over 'disregard for' the Constitution

The state of Maryland and the District of Columbia plan to sue President Trump on Monday, alleging that he has violated the Constitution by accepting foreign money through his business empire, according to a person familiar with the plans.

Maryland Attorney General Brian Frosh and D.C. Attorney General Karl Racine said they will make a formal statement Monday afternoon.

The lawsuit, potentially historically unique, focuses on payments and benefits to Trump's businesses from foreign governments and the president's failure to keep promises to separate public and private business, the report said.

The lawsuit, first reported by The Washington Post, comes months after state lawmakers in Annapolis gave Frosh broad authority to bypass the governor and sue the federal government on a range of issues. The attorneys allege Trump violated the Constitution's emoluments clause. For instance, the president still receives routine updates on the company's finances.

"We're getting in here to be the check and balance that it appears Congress is unwilling to be", Racine told the Post, describing the case.

In January, Trump vowed to track and donate all profits made by Trump Organization from foreign governments to the U.S. Treasury. The government also said Trump hotel revenue does not fit the definition of an improper payment under the constitution. Saudi Arabia, the destination of Trump's first trip overseas, also booked rooms at the hotel through an intermediary on more than one occasion since Trump's inauguration.
