Bill Cosby's Sexual Assault Case Ends in a Mistrial After Jury Deadlocks

Accuser was less consistent with the accused’ Cosby attorney

Defense attorneys had pushed to select a jury from another county because of intense pretrial publicity in Montgomery County, Pennsylvania, where District Attorney Kevin Steele, during his 2015 election campaign, had been critical of one of his predecessors for not prosecuting Cosby.

Jurors continued their work a day after telling the judge they were unable to reach agreement on a unanimous verdict.

The search for jurors without any feelings on the case will only be more hard given the intense coverage of the first trial.

Cosby, the actor and comedian known as "America's Dad", turns 80 next month facing just that ordeal. Prosecutors say they will retry the case.

In a retrial, District Attorney Kevin Steele could ask the judge to allow testimony from more of Cosby's 60 accusers, or to disclose to jurors that Constand is gay. She felt it was her fault for years before other women began sharing similar stories, giving Janice the courage to come forward. The defense had hoped, if it did, to introduce evidence she had previously dated a man.

Cosby, who pleaded not guilty to the charges, did not take the stand during the weeklong trial, though excerpts from his 2005 and 2006 depositions about his relationship with Constand were read aloud. In that decision, O'Neill blocked testimony during the trial by all but one of 13 women whom prosecutors identified as past victims and wanted to call as witnesses to establish a pattern of conduct by Cosby.

She condemned the district attorney as "heinously and exploitatively ambitious", the judge as "overtly arrogant", lawyers for the accusers as "totally unethical" and "many" in the media as "blatantly vicious". Judge Steven O'Neill could revisit the issue as early as Monday.

They deliberated for 52 hours over six days.

"It can never be clearer that if you speak up, you could be chilling the justice system in the future if jurors are needed in this case", O'Neill told them. Cosby's alma mater, the University of MA at Amherst, cut ties with him, the first in what would become a long list of organizations to do so.
