Former Playboy model who alleges affair with Trump sues company that didn’t publish her story

The New Yorker magazine last month reported on McDougal's alleged affair and a move by American Media to pay her for rights to her story, which it never published.

McDougal says Trump's personal lawyer, Michael Cohen, played a role in discussions between her and A.M.I. and that she was misled about the legal agreement she signed, according to the outlet.

The woman, Karen McDougal, filed a lawsuit Tuesday in Los Angeles against the company that owns supermarket tabloid National Enquirer.

McDougal contends AMI is keeping her quiet and avoiding publishing her content, but the company said she was featured on the cover of its highest-selling issue of Muscle & Fitness Hers in 2017.

The lawsuit claims McDougal was not told AMI had no obligation to run articles she had written or that they were simultaneously negotiating deals to kill other negative stories about Mr. Trump, and that his representatives received constant updates throughout the negotiations previous year.

Judge Jennifer Schecter in Manhattan supreme court said there was "absolutely no authority" to dismiss or stay a civil lawsuit by Zervos related "purely to unofficial conduct" just because Trump is the president of the United States. That would be the catch and kill. The company told The New York Times - which broke the story of McDougal's lawsuit - last month that it initially chose not to print her story when they first learned of her allegations a year ago because it could not verify important details.

McDougal's lawsuit comes about two weeks after similar legal action was taken by adult-film actress Stormy Daniels, whose real name is Stephanie Clifford. She says that she wanted her account to be accurate and hired entertainment attorney Keith Davidson, who "assured her that the rights to publish the story were worth millions". She was previously given a $130,000 payout for her silence on her interactions with Trump.

The lawsuit, first reported by The New York Times, is the second legal challenge this month from a woman attempting to be released from a legal agreement forbidding speaking about extramarital relations with Trump. Her lawyer then told her that the company wasn't interested in her story but that "he and AMI updated Mr. Trump's representatives about Ms. McDougal".

In response to the original Journal story about the Enquirer and McDougal, American Media Inc. denied paying to kill damaging stories about Trump.
