Officials in Orange County, a traditionally more conservative pocket of liberal California, say the law does not stop sheriff's deputies from giving immigration authorities access to jails to interview inmates.

Barnes (pictured above) said sheriffs considered challenging the law in court but made a decision to defer to the federal government.

Outside the meeting room, several dozen immigrant advocates played music and held signs with slogans such as "Set Our People Free" and "Melt ICE" to urge supervisors not to join the USA lawsuit against California.

Comparing the incident to an oft-used refrain by immigrant rights advocates who complain that deportations separate immigrant families, Robinson told the board: "Kate's family is forever separated from her".

Undersheriff Don Barnes, who is running for the top job, said Wednesday on "The Laura Ingraham Show" that the change is an effort to improve communication with Immigration and Customs Enforcement (ICE) officials who have been stymied by California's "sanctuary" law. In another contentious matter at Tuesday's meeting, the Orange County Board of Supervisors voted to rescind a plan for potentially opening homeless shelters in Irvine, Huntington Beach and Laguna Niguel that could house up to 400 people.

"We can not let the state begin cherry-picking which federal laws it decides to follow".

The move comes a day after the County Sheriff's Department announced that it will make public a list of when inmates are released from custody. "Will you be able to do that?"

Spitzer, a former prosecutor who now is running for District Attorney, said it's too unsafe to law enforcement to let people out of jail while another law agency is looking to arrest them.
