GOP risks fallout over move on health law | Health care act

The Trump administration is calling a key part of Obamacare that protects individuals with pre-existing conditions unconstitutional

The lawsuit, filed in February by Texas and other GOP-led states, is in many ways a replay of the politically divided litigation that ended with the Supreme Court upholding the health care overhaul in 2012. In that case, the Supreme Court held up the individual mandate as constitutional only because it could be construed as a tax that raised revenue for the government. The short version is that the administration is refusing to defend the ACA in court, even though it's standard practice for the Justice Department to defend laws even when they don't agree with them.

If the court takes that action, "the ACA's provisions containing the individual mandate as well as the guaranteed-issue and community-rating requirements will all be invalid beginning on January 1, 2019", the department lawyers write in a memorandum addressed to the court. On May 16, the court granted 17 Democratic attorneys general, led by California, permission to intervene to defend the ACA.

Attempts to repeal it in Congress have failed, but opponents of the law have also filed scores of lawsuits challenging various provisions.

“Trump and his cronies cant unilaterally roll back preexisting protections for millions of Californians, ” Newsom said.

The states say that without the individual mandate, the whole ACA should be struck down as unconstitutional.

And though the federal government will apparently no longer defend a pillar of the law, a group of left-leaning states have stepped in to back it in court.

ROVNER: Well, one of the reasons it's happening - say the insurers, who are filing their rates now for next year - is because they took away this penalty for people who don't have insurance.

"This is disgusting but not surprising". It requires insurance companies to cover people with preexisting conditions - charge them the same rates as everybody else? Chris Murphy, D-Conn., said in a statement.

So, they have called on the trial court to strike down every part of the ACA, a massive law of more than 900 pages that Congress passed in 2010. "The White House needs to hear that the American people will not stand for this", Murphy said.

But it's not clear exactly how many Americans have pre-existing conditions and could be affected.

Mental disorders, including depression and anxiety, are also considered pre-existing conditions.

"The Justice Department has an obligation to defend the law, and it has refused to do so because it dislikes this particular law", Bagley told USA TODAY.

The health care law's core consumer protections, which the president once signaled he supported, have been among the most popular parts of the law and have helped extend coverage to millions of previously uninsured Americans. This is harmful to the health of these Americans and is very short-sighted considering the nation is in the midst of an opioid epidemic and 30% rise in suicide rates.

"I am at a loss for words to explain how big of a deal this is", University of MI law professor Nicholas Bagley said in a blog post.

These two provisions, along with rules that allow children to stay on their parents' health plan until they are 26 years old, have proven popular with Americans. They included provisions establishing health insurance exchanges, expanding Medicaid coverage and subsidizing premiums for lower-income people.

But some moderate Republicans, including Sens.

"This announcement from the Administration does nothing to ameliorate the current system's instability or foster cooperation toward a solution to lower premiums and increase choices for consumers".

While they provide major protections to those with pre-existing conditions, they also have pushed up premiums for those who are young and healthy. (Case Number: 4:18-cv-00167-O) to grant a preliminary injunction that would nullify the ACA individual mandate.

Democrats had already made health care a major focus in their campaigns heading into November's midterm elections, with polls consistently showing it as a top issue among voters.

Senate Democratic Leader Chuck Schumer urged President Donald Trump to reverse the decision. As much as president Trump may dominate the headlines, the increasing cost of care is weighing heavily on voters.

Three provisions of the Affordable Care Act are unconstitutional and therefore not defensible in court, the Justice Department said.

Andy Kim, a former Obama administration staffer, is making coverage of pre-existing conditions and access to affordable health care a key part of his campaign against Rep. Tom MacArthur in Central New Jersey, the author of the Obamacare repeal bill that passed the House but failed in the Senate a year ago.
